The new ‘Code of business crisis and of insolvency’ sets very tight rules on how the plan in a judicial composition with creditors (concordato preventivo) must be drafted, with different rules for plans based on continuation of business and for liquidation plans. The article argues that it is possible to construe the law in order for it to allow also ‘atypical’ continuation plans that do not comply with all requirements set for continuation plans as defined by the law. The article then investigates the law applicable to this kind of plan.
