Abstract

Secondo la tradizione delle voci nell’Enciclopedia del Diritto, l’autore descrive l’istituto ricostruendone le origini, le varie declinazioni dottrinali e giurisprudenziali, le mutevoli applicazioni pratiche. Individuata la pluralità dei fini che si propone in quanto tecnica di pianificazione e nel contempo strumento di riequilibrio delle posizioni dei proprietari premiati o sfavoriti dalle scelte urbanistiche, e segnate le caratteristiche che la distinguono dagli istituti affini della compensazione, della premialità e della cosiddetta compensazione territoriale, ne individua i fondamenti normativi e costituzionali, rilevando come costituisca una diretta proiezione dei principi di uguaglianza e di non discriminazione che si trovano già scritti negli articoli 3 e 97 della Costituzione. Nel contempo ne delinea i limiti e l’inidoneità a governare i processi urbanistici di ultima generazione, ispirati al risparmio di suolo e al recupero dell’esistente.
