Abstract

Il Port State Control rappresenta uno strumento di grande rilevanza in un contesto caratterizzato dalla continua crescita dei traffici marittimi globali, dal fenomeno delle bandiere di comodo e dalla presenza di navi substandard. Tale strumento si concretizza nel potere, internazionalmente riconosciuto, di sottoporre ad ispezione le navi straniere in porti nazionali, al fine di stabilirne la conformità alle norme internazionali a tutela della sicurezza della navigazione, dell’ambiente marino e delle condizioni di vita e di lavoro a bordo. L’esperienza ha dimostrato come le misure del Port State Control possano risultare estremamente efficaci specialmente se organizzate su base regionale, e la firma del Paris Memorandum of Understanding on Port State Control del 1982 costituisce una importante tappa nell’evoluzione dell’istituto in esame. L’entrata in vigore, nell’ambito del Paris MoU, del «Nuovo regime di ispezione» fondato sul «risk based target mechanism » contribuisce a eliminare i vantaggi economici delle bandiere «compiacenti» e i rischi legati alle navi inferiori agli standard internazionali di sicurezza previsti.
