Abstract

Oggetto della presente rassegna sono le principali questioni sottoposte alla Corte di cassazione in materia di procura speciale, restituzione nel termine e lingua degli atti. Relativamente alla procura speciale, sono stati esaminati gli aspetti riguardanti la procura preventiva e la legittimazione del difensore dell'offeso, iscritto nell'apposito albo speciale della Corte di cassazione, ma non munito di procura speciale ad hoc. Riguardo alla restituzione nel termine viene esaminato il caso dell'imputato contumace e le modifiche all'art. 175 c.p.p. Infine, in tema di lingua degli atti, si richiama la giurisprudenza consolidata, per la quale, nel caso di imputato alloglotta, devono essere oggetto di traduzione, a pena di nullità, sia la sentenza di merito, sia l'avviso di conclusione delle indagini preliminari.
