Abstract

Il contributo si pone lo scopo di verificare come operino, nel processo canonico, i principi inquisitorio e dispositivo. Prese le mosse dalla particolare configurazione che, nell'ordinamento canonico, hanno processo, prove ed eccezioni, si procede analizzando lo spazio che i due suddetti principi hanno avuto nel Codex del 1917 e quello che rivestono nel Codex del 1983, soprattutto alla luce di quanto contenuto al riguardo nella Istruzione "Dignitas Connubii"
