Abstract

Collocata fuori dal tessuto codicistico e senza alcun tentativo di sistemazione nel contesto delle indagini preliminari, la disciplina sulle operazioni sotto copertura è fiorita nella normativa speciale, per effetto, ogni volta, di programmi anticrimine tesi ad inasprire la risposta ordinamentale a fenomenologie delittuose suscitanti peculiare allarme sociale. La trama gradualmente imbastita ha offerto copertura legislativa ad uno strumento d’indagine singolare ed eccezionale, potenzialmente lesivo di prerogative individuali ed ai confini con la legalità; per tale ragione, a lungo relegato tra le pratiche poliziesche “sommerse” ed adoperato in contesti pre-investigativi come mezzo per “formare” la notizia di reato. In assenza di una disciplina dinamica dell’investigazione, tesa a fissarne requisiti fattuali di azionabilità, modalità di documentazione, limiti operativi, garanzie difensive, sanzioni processuali, è ai principi sovraordinati (divieto di provocazione, tutela della privatezza e nemo tenetur se detegere) che occorre esegeticamente risalire per individuarne gli argini.
