Derechos constitucionales medioambientales y democracia liberal

Abstract

Este artículo analiza los argumentos en favor de la obtención de fines ecológicos con medios constitucionales. En la primera sección se esboza una defensa de los derechos constitucionales ambientales y una defensa más amplia del reconocimiento constitucional de los intereses ecológicos como intereses generalizables. En la segunda sección se destacan algunas cuestiones que una propuesta como ésta suscitan en la teona política, tanto normativa como explicativa. Entre ellas se cuentan la de atrincherar constitucionalmente el reconocimiento de determinado tipo de intereses y de confiar en las medidas constitucionales propias del Estado liberal, particularmente en un contexto en el que la globalización está minando su priviliegiada posición política y se combina con la naturaleza transfronteriza de numerosos problemas ecológicos. El autor sostiene que tales cuestiones deberían situarse entre las prioridades de investigación de los teóricos políticos, ya que afectan a temas clave de la disciplina, no sólo en lo que se refiere al significado sustantivo de la justicia social y de la vida buena en una comunidad política, sino también a la naturaleza de la democracia liberal y del Estado.
