El Código Civil no contiene un precepto que regule específicamente las consecuencias de la intervención de la culpa de la víctima en un resultado dañoso. Los juristas romanos de época republicana elaboraron algunas nociones de culpa extracontractual a partir de la "lex Aquilia" que siguen siendo aprovechadas por nuestra jurisprudencia para concretar las consecuencias de aquellas conductas lesivas acaecidas por culpa de la víctima. Ahora proponemos un análisis jurisprudencial de la compensación de culpas y de la degradación de la responsabilidad derivada del hecho causado por la propia víctima.

The Civil Code doesn’t contain a precept that specifically regulates the consequences of the intervention of the victim's fault in a harmful result. The Roman jurists of the Republican period elaborated some notions of non-contractual fault based on the "lex Aquilia" which are still used by our jurisprudence to specify the consequences of those harmful conducts caused by the fault of the victim. We now propose a jurisprudential analysis of the compensation of fault and of the degradation of the liability derived from the fact caused by the victim.
