Abstract

Este trabajo se desarrolla en torno al estudio de dos sentencias en las que la aplicación del art. 325 CP (tipo básico del delito medioambiental) proporciona resultados antagónicos y desproporcionados en cuanto al resultado fáctico, víctimas del delito, relevancia del bien jurídico protegido y solicitud inicial de penas en ambos casos. Se plantea así la disyuntiva entre acudir al derecho público o al derecho privado en orden a la eficacia de la protección medioambiental.
