ABSTRACT: The copyright, from a constitutional point of view, should be better understood taking into account its double nature: as a fundamental right as well as a property right. In addition it plays a role as an institutional guarantee of different constitutional rights. In this context, the limits of copyrights should be examined, specially the limit of private copy on Internet. RESUMEN: El derecho de autor podría ser interpretado, desde el punto de vista constitucional, considerando su contenido de doble naturaleza, como derecho fundamental y como derecho de propiedad ordinario. Al mismo tiempo, constituye una garantía institucional que refuerza diversas realidades constitucionales. En este contexto, se examinan los límites al derecho de autor, en concreto, el límite de copia privada que, en el entorno digital, ha provocado una grave crisis al derecho de autor.
