Abstract

Se puntualiza que el trabajo versa sobre aquellos obstáculos que el ordenamiento jurídico establece en forma directa o indirecta al acceso efectivo del contribuyente a la justicia administrativo-tributaria y no sobre las garantías que el mismo ordenamiento contempla como medio de tutelar los derechos e intereses de los administrados. Se sistematizan todos los obstáculos que el ordenamiento costarricense presenta al contribuyente en la defensa de sus derechos; y se enjuician a tenor de la doctrina y legislaciones y sus respectivas jurisprudencias de otros países - principalmente de España e Italia - y desde el ángulo de la experiencia costarricense. Los obstáculos para el acceso a la justicia administrativo-tributaria en el derecho costarricense con apoyo en la exposición que se hace se basan en la mayoría de los casos en una falta de carácter general de la legislación correspondiente por la ausencia de regulación o la existencia de una normativa inadecuada de institutos jurídicos del procedimiento que atentan contra el principio de seguridad jurídica principalmente en la vía previa administrativa o a la existencia de figuras.
