Etica del disgusto e transfobia. Una riflessione critica

Abstract

Il genere e la sessualità sono parte integrante dell’identità personale, e costituiscono la componente più intima della sfera della vita privata. In questo senso sono oggetto di una specifica tutela normativa, assicurata in primo luogo dall’articolo 8 della Convenzione per la salvaguardia dei diritti dell’uomo e delle libertà fondamentali del Consiglio d’Europa e dall’articolo 7 della Carta dei diritti fondamentali dell’Unione europea (divenuta vincolante in seguito all’entrata in vigore del Trattato di Lisbona, nel quale è inclusa). Il diritto alla vita privata è stato ribadito da strumenti di regolazione in ambito bioetico, quali la Convezione sui diritti dell’uomo e la biomedicina del Consiglio d’Europa (articolo 10 “Vita privata e diritto all’informazione”) che ne ha statuito la rilevanza quale principio bioetico fondamentale, soprattutto negli ambiti in cui esso è più direttamente connesso alle garanzie di integrità, libertà e autodeterminazione sul proprio corpo, e alle misure di protezione riguardo le possibili utilizzazioni dei dati sanitari.
