Abstract

Bandit de grands chemins, des mers ou de l’internet, le pirate fait figure de voleur patenté qui peut commettre le pire pour servir son propre intérêt. Mobile et opportuniste, prompt à investir les zones de non-droit et les terres franches, le pirate est doué d’une habileté, d’un savoir-faire : celle du faussaire, du passe-muraille qui se glisse dans les brèches pour infiltrer et défier les tenants d’un ordre qu’il veut déjouer au risque d’être assimilé au terroriste qu’il n’est pas toujours. La veille active des organisations pirates, qu’elle soit anonyme ou non, clandestine ou revendiquée, silencieuse ou tapageuse, échappe aux catégories habituelles du droit et interroge les principes de la propriété intellectuelle, de la circulation des biens et des idées mais aussi la légitimité des gouvernances. Abolition des brevets pharmaceutiques et des droits d’auteurs, licences alternatives et mouvance copyleft, Deep Web ou Darknet, parti pirate ou punk attitude, roman d’aventures ou essai insurrectionnel, activisme forcené ou performances dans l’espace public, défense des libertés fondamentales ou plateforme criminelle : autant d’enjeux socio-politiques et esthétiques dont les artistes et penseurs de ce numéro pourront explorer les trésors et les profondeurs.
