Justice transitionnelle et jus post bellum

Abstract

La justice transitionnelle peut être définie comme une conception de la justice associée aux périodes de changements politiques, lesquels sont des réponses aux préjudices commis par les régimes du passé. Le jus post bellum est, avec le jus ad bellum et le jus in bello, l'une des trois grandes catégories des théories de la guerre juste. Il porte plus précisément sur les modalités de la réparation en contexte d'après-guerre. Il s'agira, au cours de ces conférences, d'analyser les principales problématiques de la justice transitionnelle suite aux conflits, qu'il s'agisse de guerres civiles ou de guerres entre États distincts. Ce cycle sera présenté en deux parties, la première portant sur les enjeux de la justice transitionnelle au sujet des crimes perpétrés dans le passé, la seconde sur les processus de construction des institutions démocratiques en contexte d'après-guerre, et sur la nécessaire articulation des demandes de justice, de démocratisation et de pacification.
