Abstract

El presente trabajo aborda el problema de actual coyuntura, relativo a aquellos supuestos en donde, en la práctica forense, dentro de un proceso penal el abogado defensor, público o privado al empezar a conocer un caso, ya en etapa de juzgamiento advierte que la primera defensa omitió ofrecer elementos de prueba obtenidos durante la investigación preparatoria, que resultan útiles, pertinentes y conducentes para acreditar la teoría del caso favorable al imputado, nuestra legislación procesal penal actual prevé el ingreso de nueva prueba en el artículo 373, sin embargo no contempla un supuesto de defensa técnica ineficaz -que es lo que ha ocurrido en el supuesto anteriormente descrito- generándose un vacío normativo en perjuicio el imputado, por lo que se analizará la posibilidad de una reforma lege ferenda del artículo antes citado así como establecer los presupuestos para su regulación.
