Reforma institucional en la gestión pública ambiental

Abstract

Desde la aprobación del Código del Medio Ambiente y de los Recursos Naturales en 1990, la gestión pública ambiental en el Perú no ha encontrado la manera de superar dos problemas fundamentales: primero, la necesidad de implementar un sistema transectorial con autoridad para aprobar estudios de impacto ambiental en todos los sectores y con capacidad para fiscalizar su cumplimiento; y, segundo, el urgente desarrollo de un sistema descentralizado de información y vigilancia ambiental con roles claramente definidos en los diferentes niveles territoriales. La evolución del Consejo Nacional del Ambiente (CONAM) a lo largo de sus 12 años de vida institucional muestra las limitaciones existentes en el país para alcanzar una gestión transectorial y descentralizada. Durante el último semestre del 2006 tanto la Defensoría del Pueblo como el Banco Mundial promovieron el debate acerca de la necesidad de una reforma en el sistema de gestión pública ambiental, apuntando hacia la definición de una autoridad ambiental con autonomía y capacidad de fiscalización. El desafío no sólo consiste en administrar la transectorialidad en un contexto institucional en que los sectores involucrados tienen diferente poder o margen de maniobra, sino fundamentalmente en el desarrollo de capacidades de gestión pública en distintos niveles territoriales.
