Abstract

El trabajo de investigación científico, titulado “OBLIGATORIEDAD DE ESTABLECER INDICIOS DESDE LA ETAPA DE INVESTIGACIÓN PREPARATORIA PARA GARANTIZAR EL DERECHO DE DEFENSA DEL PROCESADO” determina la necesidad de que los operadores jurídicos – Representantes del Ministerio público, señalen de manera obligatoria desde la etapa de investigación preparatoria del proceso penal, los indicios que se tengan en contra del procesado, con la finalidad de que estos soliciten diligencias que generen contraindicios que les permitan defenderse y que en el devenir del proceso puedan postularse y actuarse. El objetivo es elaborar la propuesta de modificación del literal b del numeral 2 del artículo 336 del Código Procesal Penal que incorpore la obligatoriedad de establecer indicios desde la etapa de investigación preparatoria, evitando la vulneración del derecho de defensa del procesado. Los resultados obtenidos reflejan que corresponde al persecutor del delito garantizar completamente el derecho de defensa de los sujetos procesales, señalando obligatoriamente indicios desde la etapa de investigación preparatoria; finalmente, que el derecho de defensa se garantizaría al establecerse de manera obligatoria los indicios desde la etapa ya señalada.
