La propiedad urbanística: una propiedad desmaterializada y espiritualizada

Abstract

El concepto clásico de propiedad de corte romanista, ilimitado, inviolable y sagrado, que todo lo puede y todo lo accede, que se extiende desde el cielo hasta el infierno, que incorpora el code francés e influencia nuestro código civil, va a sufrir durante el siglo XIX y XX, en nuestro país, una evolución hacia un nuevo concepto de propiedad que denominamos propiedad urbanística. En esta evolución, nos interesa destacar dos procesos que paralelamente afectan de forma esencial al Derecho de propiedad: La desmaterialización y espiritualización del Derecho de propiedad urbanística. El proceso de desmaterialización se produce por el debilitamiento de la extensión y facultades del propietario. La extensión ilimitada del dominio que alcanza desde el cielo hasta el infierno, va paulatinamente perdiendo fuerza por influencia de leyes especiales, tales como las de minas, aguas, y por influencia de las leyes de policía (hoy día deben entenderse como urbanísticas). Se pone de manifiesto, igualmente, un proceso de espiritualización del Derecho de propiedad inmobiliaria, en cuanto que el mismo evoluciona desde el ámbito civil, hacia la legislación urbanística, y se sintetiza en un nuevo concepto: el aprovechamiento urbanístico. El aprovechamiento urbanístico se constituye como la síntesis y esencia del contenido de la propiedad urbana así como la verdadera medida de su valor. Se conforma como una realidad independiente y autónoma de la base de la que trae causa: El suelo.

The classic real property concept, Roman based, limitless, inviolable and sacred, which happens to be all powerfull and fully comprehensive, whose influence extends from heaven towards hell, which was adopted by the french Civil code, and influenced our Civil code, during the XIX and XX century, is going to suffer, in our country, an evolution towards a new real property concept, called urban property. In this evolution, we are mostly interested to emphasize two processes which influence in parallel essentially the real property: Dematerilization and spiritualization of urban property. The dematerialization process will affect the limitless extensión and faculties of owners, and real property will weaken due to the irruption of special regulations, such as wáter, mine, and pólice power laws, (these could be referred nowadays as urban laws). It is important to state that there is also a espiritualización process going on. The real property moves from the civil towards the urban regulation, which synopsize a new concept: development right. Development rights conforms the synthesis and essence of urban property and its value measurement. It becomes an independent and autonomus reality which originates in the land. All along this evolution, two new figures come up: Town-planning agreements and the property development agent which influence the mentioned processes.
