La presente tesis se titula: “Naturaleza jurídica de la obligación del empleador en la atribución de responsabilidad civil por accidentes de trabajo”, la cual se ha orientado a determinar la naturaleza jurídica de la obligación del empleador cuyo incumplimiento causa un accidente de trabajo debiéndosele atribuir responsabilidad civil, se aborda con el diseño de investigación cualitativa de la teoría fundamentada, mediante la cual se obtiene información de las categorías del fenómeno, así como las teorías que la explican. Asimismo, haciendo uso de la técnica de análisis documental y la técnica del fichaje, mediante los instrumentos de ficha de análisis, fichas bibliográficas y de resumen, se acepta la hipótesis planteada. El resultado más resaltante es que el empleador en su calidad de agente deudor de la seguridad y salud en el trabajo asume en algunos casos una obligación de medios y en otros una obligación de resultado, concluyendo que la naturaleza jurídica de la obligación del empleador, debe ser considerada en virtud del deber de prevención como una obligación de medios, exigiéndosele obrar con diligencia ordinaria, cuyo alcance lo determina el tipo de actividad realizada y en virtud del deber genérico de no dañar, responderá por el riesgo creado, siendo una obligación de resultado.

The present thesis is entitled: "Legal nature of the employer's obligation in the attribution of civil liability for work accidents", which has been oriented to determine the legal nature of the employer's obligation whose non-fulfillment causes a work accident and should be attributed civil liability, it is approached with the qualitative research design of the grounded theory, through which information is obtained from the categories of the phenomenon, as well as the theories that explain it. Likewise, by using the documentary analysis technique and the file technique, by means of the analysis card, bibliographic and summary cards, the hypothesis proposed is accepted. The most outstanding result is that the employer in his capacity as the agent responsible for safety and health at work assumes in some cases an obligation of means and in others an obligation of result, concluding that the legal nature of the employer's obligation must be considered by virtue of the duty of prevention as an obligation of means, requiring him to act with ordinary diligence, whose scope is determined by the type of activity performed and by virtue of the generic duty of not harming, he will respond for the risk created, being an obligation of result.
