Abstract

Los autores analizan en el marco de la gobernanza a través del crimen que se ha extendido actualmente en el mundo, principalmente en los países periféricos, la razonabilidad y legitimidad de la mal denominada pena de muerte, que constituye un clamor popular y revela una de las manifestaciones más visibles del populismo punitivo de nuestros días. El objetivo del artículo es fomentar la toma de conciencia respecto a la necesidad de una estricta cautela criminológica en el ejercicio del ius puniendi estatal, cuyo uso selectivo, discriminatorio y violento crea criminalidad, derecho de castigar que en el caso de la máxima pena, concluyen los autores, devendría en el ocaso de la pena toda vez que semejante acto de crueldad insólita es impropio del concepto penal de sanción en un sistema penal democrático.

The authors analyze in the framework of governance through crime that has now spread throughout the world, mainly in peripheral countries, the reasonableness and legitimacy of the so-called death penalty, which constitutes a popular clamor and reveals one of the most visible manifestations of punitive populism of our day. The objective of the article is to promote awareness of the need for a strict criminological caution in the exercise of the State punishments, whose selective, discriminatory and violent use creates criminality, the right to punish that in the case of the maximum penalty, they conclude the authors, it would become in the twilight of the penalty whenever such an act of unusual cruelty is unfit for the penal concept of sanction in a democratic penal system.
