Abstract

Изследването е посветено на анализа и сравнението между отделните способи за уреждане на инвестиционни спорове. Разгледани са материалните и процесуални предпоставки за решаването на инвестиционен спор от държавен съд, както и с алтернативни способи: помирение, медиация и арбитраж. Систематизирани са предимствата и недостатъците на всеки от посочените способи за уреждане на инвестиционни спорове.Застъпена е тезата, че в международния инвестиционен процес най-използваният и ефективен способ за решаване на инвестиционни спорове е арбитражът. Сравнени са арбитражните производства, администрирани от Международния център за разрешаване на инвестиционни спорове, учреден по силата на Конвенция за уреждане на инвестиционни спорове между държави и граждани на други държави („Центъра“) и арбитражните производства, водени по арбитражния правилник на Комисията на ООН по международно търговско право („Правилника на УНСИТРАЛ“). Разграничението е направено от гледна точка на международна компетентност, процесуални срокове и гаранции за прозрачност, допускане на обезпечителни мерки и постановяване на решение по спора. Систематизирани са проблемите в действащата система за уреждане на инвестиционни спорове и внимателно е анализирана критиката срещу арбитража по инвестиционни дела. Обсъдени са различни предложения за преодоляване на кризата в съществуващата система от способи за уреждане на спорове – за изменение в текстовете на спогодбите за закрила на инвестициите и арбитражните правилн

The research is devoted to the analysis and comparison of the various methods of settling investment disputes. The material and procedural prerequisites for the resolution of an investment dispute by a state court as well as through alternative means: conciliation, mediation, and arbitration are considered. The advantages and disadvantages of each of the above-mentioned methods of settling investment disputes are systematized. It is argued that in the international investment process the most used and effective means of resolving investment disputes is arbitration. The arbitration proceedings administered by ICSID and the arbitration proceedings under the Arbitration Rules of the United Nations Commission on International Trade Law ("UNCITRAL Rules") are compared. The distinction is made in terms of international competence, procedural deadlines, and guarantees of transparency, provisional measures and decision-making. The problems in the current system for settling investment disputes have been systematized and the criticism against investment arbitration has been thoroughly examined. Various proposals have been discussed to overcome the crisis in the existing dispute settlement system - to amend the texts of the BITs and the Arbitration Rules; to promote alternative dispute resolution mechanisms - mediation and conciliation; and a proposal for the establishment of a permanent investment court.
