Officials electronic editions of the normative legal acts

Abstract

The dissertation presents a complete organizational and normative model for the official electronic publication of the Laws in the Republic of Bulgaria. This model covers authentic electronic promulgation on the one hand of the legal text as adopted by Parliament and on the other hand on its consolidated version. Chapter I of the dissertation reveals the characteristics of the current legislative process, which, although it implies electronic, taking into account: submission bills to the National Assembly; exchange and sending for promulgation, after all Bulgarian parliamentary procedure ends with verification of the adopted regulatory text on paper. The conclusion of this chapter defines the subject of the dissertation, namely – the phases of the legislative process. Chapter II sets out the specific technical, technological and regulatory prerequisites that must be fulfilled in our country in order Bulgarian State Gazette to be published authentically in the digital environment. Chapter III outlines the problem of legislative consolidation. The official electronic publication of consolidated legislation reveals a previously unknown scientific perspective, which awaits its solution in the legal theory. This juridical phenomenon has not been the subject of detailed research. In addition, I clarified the role, place and functions of the legislative body in the process of recognition consolidated laws as legally binding.

В дисертацията е представен цялостен организационен и нормативен модел за официалното електронно публикуване на нормативните актове в Република България. Този модел обхваща автентичното електронно обнародване от една страна на правния текст във вида, в който е приет от парламента и от друга страна на консолидираната му версия. В Глава I на дисертацията се представя настоящият модел на законодателния процес, който въпреки, че предполага електронно: внасяне на законопроектите в Народното събрание; обмяна и подаване за обнародване, приключва с удостоверяването на приетия нормативен текст на хартиен носител. В извода на тази глава е посочен предметът на научния труд, а именно – фазите на законодателния процес. В Глава II са посочени конкретните технически, технологични и нормативни предпоставки, които трябва да бъдат изпълнени, за да се осъществи надлежно автентично обнародване на „Държавен вестник“ у нас. В Глава III на научния труд се въвежда проблематиката за консолидацията на нормативните актове. Официалното електронно публикуване на консолидираните нормативни актове извежда непозната досега перспектива от научна гледна точка, която очаква своето разглеждане и изясняване. Това правно явление не е било обект на подробни научни изследвания. В тази част от труда съм изяснил ролята, мястото и функциите на законодателния орган в процеса по признаването на консолидираните закони за официални.
