Abstract

The research examines the procedural aspects of the revocatory action, with particular focus on the effects, foundation, and legal nature of the judgment granting the claim. Once its constitutive nature is established, the analysis addresses issues such as compensatory revocatory action, the enforceability of any condemnatory provisions within a constitutive judgment, and the admissibility of the revocatory exception. Attention is also given to matters concerning passive standing, with reference to the procedural roles of the third-party transferee, the sub-transferee, and the debtor. The research concludes with an analysis of litisconsortial issues arising in the context of legal institutions such as marital community property, family asset funds, trusts, and destination deeds under article 2645-ter of the Italian Civil Code.

L'indagine analizza i profili processuali dell’azione revocatoria ordinaria, con particolare attenzione agli effetti, al fondamento e alla natura della sentenza che ne accoglie la domanda. Sostenuta la sua natura costitutiva, lo studio si concentra su temi quali la revocatoria risarcitoria, l’esecutività di eventuali capi condannatori e l’ammissibilità dell’eccezione revocatoria. Sono poi esaminate le questioni relative alla legittimazione passiva, con riguardo alle posizioni processuali del terzo acquirente, del sub-acquirente e del debitore. Chiude l’analisi un approfondimento sulle problematiche litisconsortili connesse a istituti quali comunione legale, fondo patrimoniale, trust e atti di destinazione ex art. 2645-ter c.c.
