Once its constitutive nature is established, the analysis addresses issues such as compensatory revocatory action, the enforceability of any condemnatory provisions within a constitutive judgment, and the admissibility of the revocatory exception. Attention is also given to matters concerning passive standing, with reference to the procedural roles of the third-party transferee, the sub-transferee, and the debtor. The research concludes with an analysis of litisconsortial issues arising in the context of legal institutions such as marital community property, family asset funds, trusts, and destination deeds under article 2645-ter of the Italian Civil Code.

L'indagine analizza i profili processuali dell’azione revocatoria ordinaria, con particolare attenzione agli effetti, al fondamento e alla natura della sentenza che ne accoglie la domanda. Sostenuta la sua natura costitutiva, lo studio si concentra su temi quali la revocatoria risarcitoria, l’esecutività di eventuali capi condannatori e l’ammissibilità dell’eccezione revocatoria.
