Genel kamu hukukunda e-devlet

Abstract

E-government has become an important concept with the application of information technologies and especially internet in the public sector since the last years of the 20th century.The subject of the thesis is the concept of e-government in the context of general public law. The thesis consists of three parts. In the first part of the thesis, the concept of electronic government, the development of electronic government and e-government issues in Turkey were discussed. In this part, the relation between e-government and globalization, information society and neoliberalism are also examined. In the second part of the thesis whom title is Public Administration and e-Government, new public management and governance approaches were examined. The concept of e-government has been dealt with in relation to the concepts of public service, bureaucracy, relation to public personnel regime, new public management and governance. In the third part of the thesiswhom title is public law and e-government, the relation between the concept of e-government and constitutional principles and fundamental rights and freedoms is examined. In this context, the relation between the social state principle, the rule of law principle the democratic state principle and e-government, the problem of internet access as a human right, the right of private life and the concept of cyber security / national security issues and e-government are examined.

E-devlet, 20. yüzyılın sonlarından itibaren bilişim teknolojilerinin ve özellikle internetin kamu sektöründe uygulanmasıyla birlikte önem kazanan bir kavram halini almıştır. Tezin konusu; e-devlet kavramının genel kamu hukuku bağlamında incelenmesidir. Tez üç bölümden oluşmaktadır. Tezin ilk bölümünde elektronik devlet kavramı, elektronik devletin gelişim süreci ve Türkiye'de e-devlet konuları ele alınmıştır. Bu bölümde ayrıca küreselleşme, bilgi toplumu ve neoliberalizm kavramlarıyla e-devletin ilişkisi incelenmiştir. Tezin kamu yönetimi ve e-devlet başlığını taşıyan ikinci bölümünde ise ilkin yeni kamu işletmeciliği ve yönetişim yaklaşımları incelenmiştir. E-devlet kavramının kamu hizmeti, bürokrasi, kamu personel rejimi ile olan ilişkisi, yeni kamu işletmeciliği ve yönetişim kavramları ile bağlantılı olarak ele alınmıştır. Tezin kamu hukuku ve e-devlet başlığını taşıyan üçüncü bölümünde ise e-devlet kavramının anayasal ilkeler ve temel hak ve özgürlükler ile ilişkisi incelenmiştir. Bu bağlamda sosyal devlet ilkesi, hukuk devleti ilkesi ve demokratik devlet ilkesi ile e-devletin ilişki, internet erişiminin bir insan hakkı olarak değerlendirilmesi sorunu, özel hayatın gizliliği hakkı ve siber güvenlik/milli güvenlik konuları ile e-devleti kavramının ilişkisi incelenmiştir.
