Umetna inteligenca in človekovo dostojanstvo

Abstract

Človekovo dostojanstvo kot širok pojem in temeljna vrednota je v zakonodaji zaščiteno prek številnih posrednih in neposrednih mehanizmov. V povezavi z umetno inteligenco se pojavlja vprašanje, kako to temeljno vrednoto ustrezno zaščititi, kar je temeljna predpostavka diplomske naloge. Z deskriptivno in analitično metodo to delo podaja pregled literature in posnetek stanja trenutnih prizadevanj za regulacijo umetne inteligence, vključitev ustrezne zaščite človekovega dostojanstva v teh predlogih in njegovo vključenost v nezavezujočih aktih mednarodnopravnih organizacij. Na podlagi analize primerov uporabe umetnointeligenčnih sistemov v upravnopravnih postopkih utemeljuje, da zaradi tehnoloških omejitev sistemov umetne inteligence na področju nepristranskosti in preglednosti obstajajo potrebe po zaščiti človekovega dostojanstva z zakonodajnim okvirom, kot je Akt o umetni inteligenci, ki je trenutno v postopku sprejetja. Analiza obstoječih problemov in prizadevanj kaže na dodatno potrebo po vključitvi deležnikov iz pravnih in računalniških znanosti. Hkrati je, glede na čas pisanja tega dela, ko je potencial aplikacij umetne inteligence v porastu, potrebna raziskava in razprava o vključitvi človekovega dostojanstva v pravne okvire v njihovih temeljih neposredno, ne zgolj posredno prek etičnega razvoja in uporabe umetne inteligence. Posebej je nujen kritičen pogled na uporabo umetnointeligenčnih rešitev v postopkih javne uprave in sodstva.
