Omejitve svobode govora na primeru spletnih korporacij

Abstract

Svoboda govora je del svobode izražanja in je po celem svetu zavarovana z ustavnopravnimi akti. Je ena najpomembnejših pravic in je ključna za normalno delovanje demokratične družbe. Spletne korporacije na svojih velikih spletnih portalih (Twitter, Facebook, YouTube) postavljajo pravila in sprejemajo ukrepe, ki prekomerno in nesorazmerno posegajo v svobodo govora. Vse to vodi v družbeno stanje, kjer prevladuje glas enega političnega pola, medtem ko je drugi zatrt s strani korporacij, ker ni v skladu z njihovo agendo. Družba tako izgublja na demokraciji in vladavini ljudstva, ki sta bila dolgo ponos zahodne civilizacije. Namen diplomskega dela je s pravnega vidika preučiti omejitve svobode govora na določenih portalih ter primerjati slovensko in tujo ustavnopravno ureditev pravice do svobode govora s poudarkom na pravu ZDA. Cilji diplomskega dela so raziskati različne ukrepe spletnih korporacij, ki omejujejo svobodo govora in presoditi o njihovi zakonitosti in ustavnosti z vidika slovenskega in tujega prava, s poudarkom na pravu ZDA. Pri raziskovanju so bile uporabljene opisna metoda, analiza in interpretacija, primerjalna, sintetična, deduktivna in induktivna metoda. Ugotovitve diplomskega dela bodo prispevale k razumevanju posegov zasebnih korporacij v svobodo govora in spodbudile diskusijo o njihovi omejitvi s strani državne oblasti.

Freedom of speech, as part of freedom of expression is one of the most important human rights, as it plays a fundamental role in any free and democratic society. Big private internet corporations are restricting freedom of speech on their social media platforms (Twitter, Facebook, YouTube) with internal rules and guidelines which are restricting freedom of speech much too broadly. This results in a society, where the voice of only one political spectrum prevails, while the other is being silenced by big internet corporations, as it doesn't agree with their agenda. The purpose of this thesis is to research these restrictions of freedom of speech from the perspective of Slovenian, European and American constitutional law. The goal of this thesis is to research the many restrictions of freedom of speech and to determine if they are indeed constitutional. The methods used in this thesis are description, analysis and interpretation, comparation, synthesis , induction and deduction. The findings of this thesis will broaden the understanding of the restrictions, posed by private internet corporations and will help stir the discussion about restricting these corporations by means of government.
