The diploma work involve area of criminal liabillity of high-ranking officers of state on national and international area, especially criminal liabillity from foreign criminal jurisdiction, therefore criminal liabillity before foreign courts. The work include historical development of sovereign, his immunity and liabillity of state officials. We will get to know state officials and theirs immunity, the manner and duration of immunity,possibillity of revoking the immunity and theirs criminal liability. The majority of work is focused on criminal jurisdiction state officials from foreign criminal jurisdiction, therefore, there is more detail defain the meaning of immunity wich defend the holder of immunity from criminal liabillity, the range of immunity and possible exceptions. Important are state officials who derive their immunity from international customary law, as there is importance of work of International Law Commission, the work oc special rapporteurs R.A. Kolodkin and C. Escobar-Hernandez, which assisted in develpomend of law in direction of codification of law in area concern criminal liability from foreign criminal jurisdiction. The meaning of personal immunity and material immunity. In diploma i express my view of treated topic. It is my own opinion and i think i can include this in diploma even if i am worng. Trough the diploma i am finding out- confirming my hypothesis that the immunity of state officials from foreign criminal jurisdiction is no fully codifficated. In the last part of work i describe international grave crimes and i mention the case where the International Court of Justice for the first time in histroy issue an arrest warrant for the arrest of current president, whic derive immunity from International customary law, the Sudan president Al Bashir.

Diplomsko delo obsega področje kazenske odgovornosti visokih državnih predstavnikov na nacionalnem in mednarodnem področju, to je predvsem kazenska odgovornost pred tujo sodno oblastjo oziroma jurisdikcijo, torej, kazenska odgovornost pred tujimi sodišči. V delu je zajet zgodovinski razvoj imunitete, prav tako pa bomo spoznali nosilce javnih funkcij, način in trajanje njihovih imunitet in morebitni odvzem imunitete. Pretežni del naloge je osredotočen na kazensko odgovornost visokih državnih predstavnikov pred tujo jurisdikcijo, zato je v tem delu obširnejše obrazložena imuniteta, ki ščiti nosilce imunitet pred kazenskim pregonom, personalna in materialna imuniteta, obseg imunitete ter moţne izjeme. Pomembni so funkcionarji, ki imajo imuniteto iz mednarodnega običajnega prava, kakor je tudi pomembno delo Komisije za mednarodno pravo ILC (International Law Commission) strokovnih poročevalcev R. A. Kolodkina in C. Escobar Hernandez, ki sta s svojimi poročili pripomogla k razvoju prava v smeri kodifikacije prava na področju kazenske odgovornosti pred tujo jurisdikcijo. Prav tako bomo spoznali pomen personalne in materialne imunitete. Skozi diplomsko delo ugotavljam oziroma potrjujem hipotezo, da kazenska odgovornost visokih drţavnih predstavnikov pred tujo jurisdikcijo ni popolnoma kodificirana. V zadnjem delu naloge opišem najteţje oziroma najhujše mednarodne zločine in omenim primer, ko je Mednarodno kazensko sodišče v Haagu prvič v svoji zgodovini izdalo nalog za aretacijo sudanskega predsednika Al Bashirja, ki ima po mednarodnem običajnem pravu imuniteto rationae personae.
