Privatizacija nogometa v Sloveniji

Abstract

This article focuses on privatization of professional football clubs in Slovenia, which is currently a very interesting topic of discussion, since it has been legally introduced by the umbrella organization for football in our country due to the growing desire of the clubs for such ownership arrangements. Football Association of Slovenia has in fact adopted an amendment to Article 40 of the Law on football club licensing, which allows the ownership of the clubs to transform from the existing sports cooperative into a commercial company. Sports collectives that are organized as cooperatives have been originally established in the former Socialist Federal Republic of Yugoslavia as a part of its political system. I will introduce a few examples of aforementioned club organization in the most developed countries in the field of professional football that represent a well-managed modern football collective and its administrative structure. In addition to these countries, further overview also includes our southern neighbor Croatia, where the processes of privatization of the two biggest clubs have already taken place and are still ongoing respectively. We live in a global world, therefore I shall analyze the differences between European and American concept of managing a sports team as well. In the final part of this article, I will try to determine the inclinations that prompt people to actively participate in club management. I will also touch upon financing of football clubs in our country at present and the alternatives for obtaining additional capital, which are currently limited by rigid legislation.

Diplomski strokovni članek se osredotoča na privatizacijo nogometa v Sloveniji, kar je trenutno zelo zanimiva tematika, saj je zaradi vse večje želje klubov po tovrstni pravni podlagi in ureditvi z zakonom uvedla tudi slovenska krovna nogometna organizacija. Nogometna zveza Slovenije je namreč sprejela spremembo 40. člena zakona o licenciranju nogometnih klubov, ki omogoča lastniško preoblikovanje klubov iz sedanje društvene ureditve v gospodarsko družbo. Športni kolektivi, organizirani kot društva, so se ohranili iz obdobja nekdanje politične ureditve, ki so jo izvajali v Socialistični federativni republiki Jugoslaviji. Kot zgled urejenega sodobnega nogometnega kolektiva bom predstavil nekaj primerov omenjene ureditve klubov v nogometno najnaprednejših državah. Poleg najrazvitejših držav sem v svoj pregled vključil tudi našo južno sosedo Hrvaško, kjer so že potekali oziroma še vedno potekajo postopki privatizacije dveh največjih klubov. Živimo v globalnem svetu, zato bom analiziral tudi razlike med evropskim in ameriškim konceptom vodenja športnega kolektiva. V zaključnem delu strokovnega članka se bom posvetil vprašanju, kaj ljudi spodbuja k aktivni udeležbi pri upravljanju kluba. Dotaknil se bom tudi trenutnega financiranja nogometnih klubov pri nas in alternativnih možnosti pridobivanja dodatnega kapitala, ki jih trenutno omejuje toga zakonodaja.
