Mednarodni pravni vidik razpada SFRJ

Abstract

The break-up of the Soviet Union at the end of the 20th century has changed the geo-political image of the world. The consequences have - aside from the local situation - determined the fate of the Social Federal Republic of Yugoslavia. This thesis studies and explains the role of international law and its instruments in the case of the disintegration of SFR Yugoslavia. It studies the situation created the last Constitution of SFRY from 1974 and the consequences brought about by this new domestic regulatory framework on dealing with the disintegration of SFR Yugoslavia. The focus is on the problem of the theories of secession and country disintegration. The thesis discusses the technical instruments such as Uti possidetis iuris which have through the work of the Badinter Commission had an impact on the resolution of the Yugoslav crisis. It also highlights the problem of referendums with multiethnic nations and the problem with referendums being the basis for secession. The thesis also includes in-depth analyses of the secession of Kosovo from Serbia on the basis of the UN Resolution 1244 and the role of the international community in the process of the disintegration of SFR Yugoslavia, also taking into account the role of the European Union which convened the Hague Peace Conference on the future of SFR Yugoslavia.The thesis analyzes the new relationships which emerged in the aftermath of the Soviet break-up. As SFR Yugoslavia disintegrated, the international law faced a new problem which neither Europe nor UN had an adequate solution for. The international community was not ready which showed on the efficiency of the Yugoslav problem solving, both legally and politically. This work is a comprehensive overview of an internationally and legally important question about the disintegration of SFR Yugoslavia which has affected the international legal community and brought about new circumstances which to this day still determine the international community. The purpose of the work is not to assess the values and actions of the parties involved but rather to professionally analyze the case of disintegration without any political connotation.

Razpad Sovjetske zveze ob koncu 20. stoletja je spremenil geopolitično sliko sveta. Te posledice so poleg domačih okoliščin determinirale usodo SFR Jugoslavije. Diplomska naloga preučuje in pojasnjuje vlogo mednarodnega prava in njegovih instrumentov na primeru razpada SFR Jugoslavije. Tako preučuje okoliščine, ki so nastale z zadnjo Ustavo SFRJ iz leta 1974 in posledice te notranjepravne ureditve pri reševanju razpadu SFR Jugoslavije. Osredotoča se na dilemo med teorijo o secesijah in teorijo o razpadu države. Obravnava tehnične instrumente,kot so Uti possidetis iuris, in so prek dela Badinterjeve komisije ključno vplivala na razplet jugoslovanske krize. Izpostavlja tudi problem uporabe referenduma, pri večetničnih narodih in uporabe referenduma kot podlage za odcepitev. Podrobno analizira primer odcepitve Kosova od Srbije prek Resolucije OZN 1244 in vlogo mednarodne skupnosti v celotnem postopku razpada SFR Jugoslavije, od dela Badinterjeve komisije, do stališč EU, ki je bila pobudnik za sklic Haaške mirovne konference o prihodnosti SFR Jugoslavije. Diplomska naloga tako analizira nove odnose, ki so nastali po padcu Sovjetske zveze. Z razpadom SFR Jugoslavije so nastali precedenčni primeri v mednarodnem pravu,na katere tako Evropa kot OZN nista imeli adekvatnih rešitev. Kot takšna mednarodna skupnosti ni bila pripravljena, kar se je posledično pokazalo pri učinkovitosti reševanja problema SFR Jugoslavije, tako pravno kot politično. Diplomsko delo je tako celovit pregled mednarodno pravno zelo pomembnega vprašanja razpada SFR Jugoslavije, ki je močno zaznamoval mednarodno pravno skupnost in konkretno vpeljal nove okoliščine, ki danes determinirajo mednarodno skupnost. Namen dela ni vrednostna presoja dejanj vpletenih strani, ampak strokovna analiza primera razpada, brez političnih konotacij.
