El derecho de patentes como protección acumulada del derecho de autor en los programas de cómputo

Abstract

El software, exige una protección legal, tanto por el hecho de ser producto del ingenio del ser humano, como por la importancia que representa como elemento de la economía mundial. Actualmente los programas de ordenador, se protegen por medio del derecho de autor. No obstante su naturaleza inventiva y carácter técnico, las legislaciones del mundo difieren en sus regulaciones, en aquellas que acumulan a dicha protección la del derecho de patentes y aquellas que lo exceptúan. La postura vigente, resuelta por el Tribunal de Apelación la Oficina Europea de Patentes –OEP-, excluye de patentabilidad a los programas de ordenador cuando se reivindican como tales, y los incluye cuando muestran un efecto técnico adicional a aquel que se genera por la simple operación de un ordenador. La tesis pretende de una manera actualizada, la patentabilidad de los programas de ordenador y proponer su uniformidad en las legislaciones mundiales.
