El principio de presunción de inocencia: pilar fundamental en el Derecho Penal Canónico. [Tesina]

Abstract

El propósito de este trabajo es realizar una exploración detallada del concepto de presunción de inocencia, destacando su relevancia como pilar fundamental no solo en el ámbito legal civil, sino especialmente en el eclesiástico. Demonstrar, aunque el principio de presunción de inocencia introducido en la reforma del Libro VI del Código de Derecho Canónico de 1983 puede considerarse una innovación destacada, es importante señalar que la Iglesia ya lo aplicaba en diversas circunstancias previas a esta reforma. Además, la prominencia de la presunción de inocencia dentro del ámbito canónico se entrelaza con otros principios jurídicos fundamentales, como el derecho a la defensa y el principio in dubio pro reo.
