No solo en el contexto del derecho canónico, es bien sabido que la distinción entre la ley de matrimonio (el hombre y la mujer toman el compromiso de convivencia estable y de ayuda mutua como marido y mujer), relación matrimonial (entendida como un conjunto de recíprocos derechos y obligaciones existentes entre los cónyuges) y matrimonio-hecho (con respecto a la aplicación efectiva de la relación matrimonial a través de la convivencia y el cumplimiento de los demás deberes de solidaridad marital). En este artículo Roberto Palombi y Michela Profita, abogados ante el Tribunal apostólico de la Rota Romana, proponen una revisión de la doctrina y jurisprudencia en Italia, no solo con respecto a los procedimientos de separación y divorcio, sino también y sobre todo haciendo referencia a los juicios de exequatur de nulidad del matrimonio. En este contexto, los autores creen que una reflexión sobre las peculiaridades del orden canónico puede aportar una importante contribución a una mejor y más completa comprensión de la doctrina general en materia matrimonial, especialmente en este momento de gran incertidumbre en la ley civil.

Non only in the context of canon law, is well known the distinction between marriage-act (the man and the woman take on the commitment of stable coexistence and mutual aid as husband and wife), marriage-relationship (understood as a set of reciprocal rights and duties existing between the spouses) and marriage-fact (with respect to the effective implementation of the marriage relationship through cohabitation and the fulfillment of the other duties of marital solidarity). In this article Roberto Palombi and Michela Profita, lawyers of the Apostolic Tribunal of Roman Rota, propose a review of doctrine and jurisprudence in Italy, not only with regard to the proceedings of separation and divorce, but also and especially with reference to the exequatur judgments of nullity of marriage. In this context, the authors believe that a reflection on the peculiarities of the canonical order can provide an important contribution to a better and more complete understanding of the general doctrine in matrimonial matters, especially in this time of great uncertainty in civil law.
