In this brief article the author tries to do a first systematic approach to the preliminary investigation on the marriage causes offered by the Ecclesiastical letter in the form of “Motu Proprio” Mitis Iudex. The article addresses initially the analysis of the context of the Synod in which the Ecclesiastical letter is based on, and then offers a definition of that investigation with its particular characteristics that difference it from the preliminary criminal investigation. After that, the author goes on to explain who can develop that investigation and how it should be done. The final conclusion is a reflection on the guarantees that can be applied in this case and a brief final consideration.

En este sintético artículo se intenta ofrecer una primera aproximación sistemática a la investigación preliminar para las causas matrimoniales, ofrecida por la Carta Apostólica en forma de Motu proprio Mitex Iudex. El recorrido parte del análisis del contexto sinodal en el que se fundamenta la Carta Apostólica, para pasar a ofrecer una definición de dicha investigación con sus particulares características que la diferencien de la investigación preliminar penal. Seguidamente pasaremos a explicar quién puede desplegar dicha investigación y qué facultades asisten a quien la realice. Concluiremos con una reflexión sobre las garantías aplicables en este caso y una breve consideración final.
