This article attempts to answer the question of whether the reform of matrimonial processes introduced by the Mitis Iudex (MI) affects substantive aspects of the canonical matrimonial system and on what points and to what extent. After some preliminary considerations, the most novel features of the reform are briefly discussed. The circumstances enumerated in Article 14 of the Rules of Procedure (RP), whose presence makes it plausible to follow the processus brevior, are then analyzed one by one. Although these are not grounds for nullity in themselves, they are usually a more or less clear indication of some grounds. In some cases, they represent a novel enunciation of an existing grounds for nullity. Regarding the defect of faith and a reason for marriage other than conducting married life, the article considers the relevance of faith and marital affection to the valid celebration of the marriage.
Trata de responder a la cuestión de si la reforma de los procesos matrimoniales introducida por el Mitis Iudex (MI) incide en aspectos sustantivos del régimen matrimonial canónico y en qué puntos y medida. Tras unas consideraciones preliminares, se exponen brevemente los rasgos más novedosos de la reforma. A continuación, se analizan una a una las circunstancias enumeradas en el art. 14 de las Reglas de procedimiento (RP), cuya presencia hace plausible seguir el processus brevior. Aunque estas no sean en sí motivos de nulidad, suelen ser indicio más o menos claro de alguno de ellos. En algún caso constituyen una enunciación novedosa de un capítulo de nulidad existente. A propósito de la falta de fe y de la celebración por un motivo totalmente extraño a la vida conyugal, se hacen consideraciones sobre la relevancia de la fe y del afecto conyugal para la válida celebración de las nupcias.
