Abstract

Pese a no estar definido en el C.P.C. que es un auto interlocutorio y qué un auto de sustanciación, ello no es obstáculo para que, recurriendo a los antecedentes legislativos, doctrinarios y jurisprudenciales, se pueda hacer una definición de ellos. Así bajo la vigencia del Código Judicial una providencia era interlocutoria si bien no resolvía definitivamente la cuestión de fondo, podía repercutir sobre ella; y una providencia era de sustanciación o de trámite cuando se limitaba a disponer cualquier trámite de los que la ley establece para dar curso progresivo a la actuación dentro o fuera del juicio. Teniendo en cuenta la trascendencia que reviste la providencia judicial en todo proceso, se ponen a disposición en este trabajo algunos conceptos normativos, jurisprudenciales y doctrinales en el desarrollo de este tema que tenemos la seguridad, reviste gran importancia, para que en el futuro nuevos estudiantes de esta carrera de Derecho prosigan en la profundización en esta materia.
