Paralelo entre posesión y tenencia civil

Abstract

Como es sabido por todos la posesión y la tenencia son dos variedades de relaciones posesorias, la primera que tiene como elemento esencial el ánimos domini que consiste en no reconocer a otra persona un derecho superior sobre determinada cosa; la segunda que tiene como elemento esencial otro ánimo que el animus tenendi que no es más que reconocer a otra persona dueño de determinada cosa. Con razón ha expresado la corte que "la posesión y la tenencia se hallan estructurado por singulares y muy especiales elementos, que a la vez que impiden confundir, les permite distinguirlos fácilmente". Desarrollaremos el tema iniciado con la adquisición, siguiendo con la pérdida, luego pasaremos a la prueba, las transformaciones que se pueden dar de la una a la otra, los efectos y hasta llegar a la otra, los efectos y hasta llegar a las acciones que emanan de ella.
