Abstract

En torno a la Constitución Política y al Código de Procedimiento Penal Colombiano, consagrado en el Decreto 2700 de 1991 y reformado por la Ley 81 de noviembre 2 de 1993, encontramos que hace gala la figura jurídica denominada Flagrancia, importante en la vida institucional del país y que constituye un apremio de la situación en el que hace absolutamente imposible, la consecución del manda,niento judicial escrito, por cuanto la misma Carta de Derechos en su Artículo 32, ordena co,no evento excepcional penmtir a la autoridad pública y a los particulares la Captura sin que medie orden escrita. Lo anterior, como razón excepcional radicada en motivos de solidaridad y apoyo a la Administración de Justicia, y además, por razones eminentemente prácticas, ya que si para esta clase de actos no existiera tal excepción nos encontraríamos frente a un conflicto de poca seguridad al bien, a la cosa, a la misnia vida, y duro sería para el competente el esclarecimiento del punible a que se adecué la conducta al momento de ser investigado.
