Abstract

El problema de las relaciones entre la Iglesia y el Estado ha preocupado desde la antigüedad no sólo a los estudiosos de los asuntos jurídicos, sino a los estadistas, filósofos y a los mismos jerarcas de la cristiandad. Estas relaciones nunca han estado exenta de conflictos porque casi siempre han implicado el enfrentamiento de dos potestades que han creído tener, cada una de ellas en detrimento de la otra, la primacía en cuanto al poder de regular la vida de los miembros de una comunidad. El conflicto se inicia prácticamente al comienzo de la edad media con el florecimiento del pontificado al amparo de las teorías de Santo Tomás de Aquino, materializado por Bonifacio VIII con su tesis de las dos espadas. Los Estados, sin embargo, no se resignaron a perder el poder que la Iglesia les disputaba, por lo cual empezaron a idear formas de mantenerla en su justo lugar para no perder el la Iglesia espiritual, pleno ejercicio de su soberanía. Poco a poco fue siendo relegada a su verdadero papel, aunque no sin dificultad porque en todo esto siempre ha habido involucrado intereses de tipo material. Sin embargo, no es posible desconocer la importancia que reviste el sentimiento religioso en la mayoría de los pueblos. Por ello las constituciones modernas han consagrado el principio de la libertad religiosa y de conciencia, pero mente en como en algunos países, la especial población profesa Latino América, la mayor parte de la religión católica, los Estados han buscado. regular sus relaciones con la Iglesia y para ello se crearon los concordatos.
