Abstract

Nuestra legislación Colombiana y especialmente el Estatuto Procesal Civil, establece un minucioso estudio de las causales de nulidad en su forma y fondo, es decir, que existen normas y procedimientos que regulan las actuaciones jurídicas en cada proceso judicial, con el fin de evitar que se cometan errores en las instancias del mismo. El caso especial que nos ocupa por motivo de este ensayo, como es el saneamiento de las nulidades y que dieron lugar al recurrente, al fundamentar su impugnación contemplada en el artículo 140 numeral 5° del Código de Procedimiento Civil. En el objeto de estudio de este ensayo mediante la Sentencia 5570 de diciembre 7 del 2000, se plantea el caso que al presentarse la interrupción en el proceso, este siguió su curso normal y no se tuvo en cuenta que se aportó un documento que certificaba la imposibilidad del apoderado judicial de una de las partes para proseguir con el asunto en mención y se invocó la nulidad procesal, siendo esta susceptible de saneamiento.
