Abstract

In this study, the concept of "Privacy" is discussed. Privacy refers to all areas that are private to the individual. Privacy is an important phenomenon for both individual and social life. It is expected from human beings, who are equipped with superior features such as mind and will, to evolve throughout their lives. In this evolutionary process, privacy is a principle that must be present in most areas of life. In Islamic thought, five principles called "Zarûrati Hamse" have been determined for a life worthy of human dignity; Safety of mind, religion, life, generation and pro-perty. It has been accepted that every human being has the right to have these prin-ciples just because of their human nature. Privacy is an important element in the imp-lementation of these principles. One of the most important human needs is the need for safety/security. In Maslow's hierarchy of needs, which is accepted all over the world, the need for safety/security has taken the second place after the basic vital needs such as food, shelter and slee-ping that will ensure human survival. Privacy is a fundamental principle in meeting people's need for security in all areas. The Qur'an is the divine guide revealed by Almighty Allah to mankind. The Creator, who knows best what he has created, has described mankind to themselves with their virtues and weaknesses in his book. There is no doubt that in the Qur'an, which con-tains the principles covering the basic areas of life, there are the foundations of pri-vacy necessary for a dignified life. When the Qur'an is examined into with this pers-pective, it will be seen that this issue will be based on many verses of the Qur'an.

Bu çalışmada "Mahremiyet" kavramı ele alınmıştır. Bu kavram kişiye özel olan tüm alanları ifade etmektedir. İnsanın varlığı ile birlikte söz konusu olan mahremiyet, hem bireysel hem de sosyal hayat içerisinde önemli yeri olan bir olgudur. Akıl ve irade gibi üstün niteliklerle donatılmış insandan, hayatı boyunca tekâmül etmesi beklenir. Bu tekâmül sürecinde mahremiyet, hayatın birçok alanında bulunması gereken bir esastır. İslâm düşüncesinde, insanlık şerefine yaraşır bir hayat için "Zarûrât-ı hamse" olarak isimlendirilen beş esas belirlenmiştir; Akıl, din, can, nesil ve mal emniyeti. Her insanın sadece insan olma vasfı sebebi ile bu haklara sahip olduğu kabul edilmiştir. Mah-remiyet bu esasların hayata geçirilmesinde önemli bir unsurdur. İnsan yaşamı için önemli ihtiyaçlardan biri de emniyet/güven ihtiyacıdır. Tüm dün-yada kabul görmüş Maslow'un ihtiyaçlar hiyerarşisinde, insanın hayatta kalmasını sağlayacak yeme, içme, uyuma gibi temel hayatî ihtiyaçlardan sonra ikinci sırayı güven/emniyet ihtiyacı almıştır. Mahremiyet insanın her alandaki güven ihtiyacını teminde temel bir esastır. Kur'ân Yüce Allah'ın insanlara indirdiği ilahi rehberdir. Yarattıklarını en iyi bilen Yaratan, Kitabında faziletleri ve zaaflarıyla insanı anlatmıştır. Hayatın temel alanlarını kapsayan esasların bulunduğu Kur'ân'da, insanın şerefli bir hayat yaşaması için gereken mahremiyetin temellerinin bulunduğu şüphesizdir. Bu arayışla Kur'ân'a müracaat edildiğinde birçok âyet-i kerîme ile bu konunun temellendirilebileceği gö-rülecektir.
