CMR insurance is a kind of insurance which cover carrier?s liability arising from CMR. The carrier shall be liable for the total or partial loss of the goods and for damage thereto occurring between the time when he takes over the goods and the time of delivery, as well as for any delay in delivery (CMR, 17/1). In addition to this, carrier?s liability is arranged in the other article in CMR. But, for identified as risk in CMR insurance, it is required that carrier?s liability can lead to damage which is economic.Protection is principal debt arising from CMR insurance. In CMR insurance, compensating carrier?s damage arising from CMR is insurer?s protection debt.In this thesis, generally CMR and CMR insurance is disclosed in first and second chapter. Protection in CMR insurance is discussud in third chapter at full length. In last chapter, in conflict which arising from CMR insurance authorized and jurisdiction court, arbitration, alternative dispute resolution and limitation.

CMR sigortası, taşıyıcının CMR'den doğan sorumluluğunu teminat altına alan bir sigorta türüdür. Taşıyıcı taşınan eşyanın zıyaından, hasarından ve teslimin gecikmesinden (CMR m. 17/1) sorumludur. Bu hükme ek olarak, taşıyıcının sorumluluk halleri, CMR'de başka hükümlerde de düzenlenmiştir. Bu hallerin CMR sigortasında riziko olarak belirlenebilmesi için taşıyıcının sorumluluğunun ekonomik bir zarara yol açması gereklidir.Himaye, sigortacının sigorta sözleşmesinden doğan asıl borcudur. CMR sigortasında sigortacının himaye borcu ise, taşıyıcının CMR kapsamındaki taşımalardan doğan zararlarını tazmin etmektir.Bu çalışmada ilk bölümde genel olarak CMR, ikinci bölümde CMR sigortası açıklanacaktır. Üçüncü bölümde CMR sigortasında himayeye ayrıntı olarak ele alınacaktır. Son bölümde ise CMR sigortasından doğan uyuşmazlıklarda görevli mahkeme, yetkili mahkeme, tahkim, alternatif uyuşmazlık yöntemleri ve zamanaşımı incelenecektir.
