Abstract

The purpose of this paper is to propose guidelines applicable to the process of shared tendency in extrajudicial agreements that guarantee the best interest of the minor in Peru. This research is of a correlational type, thus the objective of the study is to determine what relationship exists between the variables shared custody and the best interest of the minor; based on the study of its content, national and international regulation; besides the transcendence of each one of them and the implications of these in the extrajudicial conciliations. It presents a qualitative research approach, since it seeks to understand the set of connected conditions that determine the institute of the family in the cooperative custody when it is granted in extrajudicial agreement. In conclusion, it was determined as an important result that although Article 7 of the Legislative Decree mentions as a criterion for consideration in reaching shared custody agreements that the conciliator in his or her actions must apply the principle of the best interests of the minor, we consider the norm to be very brief because it does not establish criteria or guidelines that are considered effective at the moment of applying the conciliators such agreements that the defense of the best interests of the infant prevails.

El presente trabajo tiene por finalidad proponer lineamientos aplicables al proceso de tendencia compartida en acuerdos extrajudiciales que garanticen el mejor interés del menor en el Perú. Esta investigación es de tipo correlacional, de esta manera el objetivo del estudio es determinar qué relación existe entre las variables custodia cooperativa y beneficio superior del menor; basándose en estudio de su contenido, regulación nacional e internacional; además de la trascendencia de cada uno de ellos y las implicancias de estos en las conciliaciones extrajudiciales. Presenta un enfoque de investigación cualitativa, pues busca entender el conjunto de condiciones conectadas que determinan al instituto de la familia en la custodia cooperada cuando es otorgada en acuerdo extrajudicial. En conclusión, se determinó como importante resultado que si bien el artículo 7 del Decreto Legislativo menciona como criterio de consideración para llegar a acuerdos de tenencia compartida que el conciliador en su actuar deberá aplicar el principio del interés superior del menor, consideramos la norma es muy escueta pues no norma criterios o lineamientos que se consideren eficaces al momento de aplicar los conciliadores dichos acuerdos que prevalezca la defensa de los intereses superiores del infante.
