El derecho matrimonial canónico

Abstract

El matrimonio canónico es aquel celebrado en forma religiosa según lo dispuesto por la Iglesia Católica. Se trata de un sistema matrimonial que se ha ido perfeccionando a lo largo de los siglos y ha tenido una gran influencia sobre el ordenamiento jurídico civil en esta materia. En este estudio desarrollamos los distintos sistemas matrimoniales y el vigente en España, para a continuación tratar aspectos de base que conforman esta institución canónica basándonos en la sacramentalidad, los fines y las propiedades esenciales. Seguidamente profundizaremos en los tres pilares fundamentales sobre los que se sostiene el sistema matrimonial canónico: la capacidad y el impedimento, consentimiento y la forma. Finalmente, abordaremos la cuestión de las causas de nulidad matrimoniales, así como sus aspectos procesales.
