Abstract

Como puede observarse por el título de este trabajo, el mismo pivota sobre dos conceptos, por un lado, la fuerza mayor, y por otro, la responsabilidad patrimonial de la Administración. Inicialmente, me acercaré a ambos conceptos por separado, para después unirlos, investigando en qué casos la fuerza mayor es un supuesto de exclusión de la responsabilidad patrimonial de la Administración y en qué casos no. Por último, por ser un tema que se encuentra tan de actualidad, que tanto preocupa, y tantas consecuencias jurídicas parece que va a tener en un futuro cercano, analizaré si la COVID-19 debería ser o no considerada como un supuesto de fuerza mayor.
