Abstract

"Atendiendo a este cuestionamiento y en relación a si el fuero de guerra no cumple con los principios del debido proceso. Las posiciones dogmáticas y fundamentalistas que sostienen que la estructura y funcionamiento de las fuerzas armadas implican que la justicia militar no sea independiente e imparcial. Y que el proceso penal militar no se ajusta a las formalidades del procedimiento establecidas en el artículo 14 constitucional. En contraste se afirma también que la principal garantía de que los tribunales militares emiten sus resoluciones con total independencia e imparcialidad se encuentra tanto en el procedimiento penal militar, que cumple con todos los principios del debido proceso, respetando los derechos de defensa del inculpado y los de la víctima, la igualdad de las partes, la publicidad de las actuaciones, estableciendo los recursos efectivos para impugnar dichas resoluciones ante un tribunal superior, que a su vez puede ser revisada por la Justicia Civil mediante el juicio de Amparo, por lo que en última instancia son los tribunales constitucionales los que resuelven si tales resoluciones se ajustan o no a derecho."
