Zona laboral gris: Repartidores de aplicaciones en Costa Rica

Abstract

El objetivo de este trabajo es abordar el problema de la laboralidad de las personas que trabajan en plataformas electrónicas, en particular los repartidores de plataformas, a partir de su consideración como una zona gris en Costa Rica, en la medida que no hemos acordado jurisprudencial o normativamente su laboralidad. A partir de un relevamiento empírico exploratorio a partir de entrevistas a trabajadores de ese sector, para, en función de la constatación de la forma como se desarrolla en la realidad la relación entre repartidores y la plataforma, poder hacer un análisis desde la perspectiva de la laboralidad. Para tal efecto se utilizan los criterios definidos en Costa Rica para tal determinación: la remuneración, la subordinación jurídica, la prestación personal y la ajenidad y la dependencia.
