Ordenamiento territorial en Costa Rica, 2010

Abstract

Esta ponencia se estudia la problemática relacionada al ordenamiento territorial en Costa Rica. El país no cuenta con una Ley de Ordenamiento Territorial, solamente ha creado una serie de leyes generales y específicas que tienen una incidencia directa en el tema. Entre ella se encuentra la a Ley de Planificación Urbana (Ley No. 4220), la cual estableció las bases para el ordenamiento y planificación del territorio, limitado al concepto urbano. Asimismo, crea el Instituto Nacional de Vivienda y Urbanismo (INVU), y le asigna una serie de responsabilidades, respecto al Plan Nacional de Desarrollo Urbano y a los planes reguladores. De estas funciones dadas por la Ley al INVU, se limita su ámbito de acción al tema urbano y no a otros conceptos más modernos como el uso del suelo en zonas agrícolas, la conservación de territorio desde el punto de vista de la biodiversidad o del paisaje, o la gestión del riesgo con un enfoque preventivo del ordenamiento territorial. El tema del ordenamiento territorial resulta ser conflictivo, sin embargo, es la clave para promover del desarrollo sostenible de los cantones, las cuencas hidrográficas y del país en general.
