El abuso de derecho y el concepto de beneficiario efectivo en materia de intereses y cánones en el contexto de los “asuntos daneses” del TJUE. Análisis de la Resolución del TEAC de 8 de octubre de 2019

Abstract

En su Resolución de 8 de octubre de 2019, el TEAC, trasladando al Ordenamiento jurídico español los pronunciamientos del TJUE de 26 de febrero de 2019 sobre los comúnmente conocidos como “asuntos daneses”, ha resuelto sobre la posibilidad de aplicar la exención de retención en el pago de intereses a una holding holandesa cuando el beneficiario efectivo reside en Andorra. El TEAC llega a la conclusión de que la interpretación de nuestra normativa doméstica (contenida en el art. 14.1.c) TRLIRNR) debe realizarse a la luz de la Directiva 2003/49/CE, pudiendo aplicarse esta directamente sin necesidad de acudir a los procedimientos fijados en nuestras cláusulas generales antiabuso, contenidas en los arts. 15 y 16 de la LGT.
