The subject of the dissertation is an analysis of the legal status of the chairman of the municipal council. The chairman occupies a special position among the councillors of the municipal self-government, esp. in the context of new powers granted to him by the legislator to give official instructions to the office employees, which significantly strengthens his position in the municipality. The unique role of the chairman of the council in municipal self-government also results from the representative function he performs on behalf of the municipal council and the range of powers the legislator has provided for him in this respect. The correctness of the current constitutional and statutory solutions regarding the competences of the chairman of the municipal decision-making body was also examined. The chairman of the municipal council performs representative functions, on behalf of the entire municipal council, and often acts as the first person representing the municipal government next to the head of the municipality. At present, there is a significant intensification of the role of the chairman of the municipal council in the local government, either in terms of internal relations within the municipal council itself and the office, or in terms of external relations, as a representative of the local government.

Przedmiotem dysertacji jest analiza statusu prawnego przewodniczącego rady gminy. Przewodniczący zajmuje szczególne stanowisko wśród radnych samorządu gminnego, zwłaszcza w kontekście przyznanych mu przez ustawodawcę nowych uprawnień do wydawania poleceń służbowych pracownikom urzędu, co znacząco wzmacnia jego pozycję w gminie. Wyjątkowa rola przewodniczącego rady w samorządzie gminnym wynika również ze sprawowanej przez niego funkcji reprezentacyjnej, wykonywanej w imieniu rady gminy oraz zakresu kompetencji, jakie przewidział dla niego w tym względzie ustawodawca. Badaniu poddana została również poprawność aktualnych rozwiązań konstytucyjnych i ustawowych dotyczących kompetencji przewodniczącego organu stanowiącego w gminie. Przewodniczący rady gminy wykonuje czynności reprezentacyjne, w imieniu całej rady gminy, często działa również jako pierwsza osoba reprezentująca samorząd gminy obok wójta gminy. Obecnie można zaobserwować istotne wzmocnienie roli przewodniczącego rady gminy w samorządzie, czy to na gruncie stosunków wewnętrznych w samej radzie gminy, czy urzędzie, czy też w stosunkach zewnętrznych, jako reprezentanta samorządu lokalnego, zajmującego pozycję niejednokrotnie o mandacie równie silnym jak mandat organu wykonawczego.
