Abstract

Introducción. Planteo del problema : el derecho como juego de lenguaje. Importancia del problema en la teoría del derecho: el razonamiento judicial. Las reglas juridicas como razones excluyentes para la acción. Las practicas de la comunidad Uno de los ejes temáticos que tradicionalmente se han señalado como casos de rupturas entre el Tractatus Logico-Philosophicus (TLP) y las Investigaciones Filosóficas (IF) ha sido oponer la facticidad del significado sostenida en el primero al convencionalismo extremo atribuido a las segundas. En efecto, el TLP es contrario al convencionalismo (y eso es compatible con la facticidad del significado). Ahora bien, es posible sostener que en las IF hay una radicalización de lo anterior, y que la comunidad de hablantes es el factum en cuestión. Sería la facticidad del significado, entonces, un caso de continuidad entre el TLP y las IF. Lo que cambia es la caracterización de ese factum: el significado está dado y su fuente es trascendental (TLP); o bien, el significado viene dado por las prácticas lingüísticas (IF).
